Requirements to register
Under the Telecommunications Ordinance (Cap. 106) (“the Ordinance”), apart from a few exceptions, such as sound and/or television broadcast receiving apparatus or radio apparatus, a license is mandatory for (a) the possession, establishment, and maintenance (or use) of a radio system and (b) dealing in the course of trade or business in radio apparatus. Consequently, an appropriate telecommunications license must be obtained from the Communications Authority (“the Authority”) before an individual can legally conduct tests or engage in the trade of radio equipment. This ensures compliance with the regulatory framework governing telecommunications.

Qualifications and credentials
Under the Telecommunications Ordinance (Cap. 106), to obtain an Experimental Station Licence or a Radio Dealers Licence (Unrestricted), applicants must be a business entity registered under the Companies Ordinance (Cap. 32) or the Business Registration Ordinance (Cap. 310), or a legally registered organization in Hong Kong. Licensees must conduct business at a pre-registered location and store all apparatus there unless written permission is obtained. They must notify the Communications Authority of any address changes, maintain transaction records for 12 months, and display the license prominently. The Experimental Station Licence is typically for manufacturers, testing laboratories, or repair workshops, while the Radio Dealers Licence allows trading and the import and export of radio transmitting apparatus. Non-approved apparatus can only be dealt with for export or with written consent.

Yes, certain RTAs are prohibited from being imported or exported unless they are manufactured for the intended purpose. Following re-export or with written consent from the CA, cordless phones also fall under the Exemption Order, as do unapproved Citizen Band radio apparatus and radio jammers.
3. What laws govern transhipment notification for Radiocommunications Transmitting Apparatus (RTA) in Hong Kong?
Transhipment notification for RTA, excluding air cargo, is governed by Section 9C of the
Telecommunications Ordinance (Cap. 106).
4. What are the requirements for transhipment notification?
Transhipment notification must be submitted at least one working day before the RTA’s arrival date.
5. What happens if I submit the transhipment notification later than required?
Delayed submissions, defined as those made less than one working day prior to arrival, are not allowed and will be classified as null and void.
