Requirements to register

Under Sections 4 and 5 of the Ordinance, anyone engaged in food importation or distribution in Hong Kong must register with the Director of Food and Environmental Hygiene (DFEH). This includes those bringing food into Hong Kong by air, land, or sea, and those wholesaling food, including producers and manufacturers. Exemptions apply to those already holding relevant licenses or registrations under other ordinances (listed in Schedule 1 of the Food Safety Ordinance). Exempt parties must still provide supplementary information if requested by DFEH. Online importers and distributors who acquire food by any means are also subject to these requirements.

Qualifications and credentials

To register as a Food Importer or Food Distributor in Hong Kong, individuals or businesses must submit a completed application to the Centre for Food Safety (CFS), providing business details, proof of business registration, and identity proof. They must pay the registration fee, comply with food safety and hygiene regulations, maintain records of food imports and distributions, and ensure imported foods meet Hong Kong's standards. Registration must be periodically renewed according to CFS requirements.

Anyone running a food importation or distribution business in Hong Kong must register with the Director of Food and Environmental Hygiene (DFEH). This includes those bringing food into Hong Kong or wholesaling it, even online. Exemptions apply to those already registered or licensed under other relevant ordinances, but they must still provide information if requested by DFEH.

After submitting your documents, you will receive a payment notification from the government department within 10 working days. Once payment is processed, you can expect to receive your distributor license within 14 working days.

Products primarily consumed as food, devoid of recommended dosages or therapeutic or health assertions, and comprised of Chinese herbal medicines commonly acknowledged as food will be categorized as such and governed under the Public Health and Municipal Services Ordinance.

To conduct a food importation and distribution business in Hong Kong, individuals or companies must undergo the process of registering as a food importer and distributor. This registration is essential for compliance with local regulations and ensuring the legality and safety of the imported food products.

In the context of the Ordinance, any individual or entity actively involved in the importation or distribution of food is considered a food importer or distributor. The acquisition of food occurs when the individual or entity gains possession or control of the food, regardless of whether it is physically under their custody or not. This includes instances where food is obtained through electronic or other means.
